
2024年2月23日下午,國際知名投資銀行董事總經理、副總法律顧問、亞太區法務主管Akash Mohapatra蒞臨中銀深圳,并舉辦座談會進行交流與分享。
在座談中,Akash Mohapatra 以國際仲裁為主題,圍繞國際投資爭端解決中心 (International Centre for Settlement of Investment Disputes)與雙邊投資協定(Bilateral Investment Treaty)展開講座,并以德意志銀行與某石油公司的套期保值協議糾紛一案為例,揭示了國際仲裁的適用、仲裁程序與裁決的執行。本所譚岳奇律師、朱耀龍律師作為主講人各自分享了處理國際仲裁案件的經驗與案例,并就與會者提出的各項問題進行了深入探討。謝蘭軍律師則針對目前國際投資形勢提出問題,并就簽署RCEP、中國與新加坡簽署雙邊投資協定后的投資者機遇展開論述。實習律師林蘇霞擔任主持人、執業律師毛丹婷擔任翻譯參與了座談會。
Akash Mohapatra認為,國際投資爭端解決中心作為一個國際仲裁機構,雙邊投資協定作為國家間簽署的條約,在跨國投資者利益受到損害且尋求東道國救濟受阻時能夠提供及時的救濟,有效的保護跨國投資者的利益,并在一定程度上解決投資者維權難、執行難的困境。
本次座談會的圓滿舉行,進一步加強了本所與外國律師的互動與專業交流,為青年律師在國際投資日益增長的背景下提供新的指引,有力提升了本所多元化爭議解決的服務水平。
ZhongYin News| Managing Director of a Well-known International Investment Bank Visits Zhongyin (Shenzhen) Law Firm and Holds a Panel Discussion
On February 23, 2024, Akash Mohapatra, the Managing Director and Associate General Counsel of a well-known international Investment Bank, visited Zhongyin (Shenzhen) Law Firm and held a panel discussion, in which Akash shared his experience and opinion regarding Alternative Dispute Resolution.
In the panel discussion, Akash Mohapatra focused on International Centre for Settlement of Investment Disputes (ICSID) and Bilateral Investment Treaty (BIT), took the hedging agreement dispute between Deutsche Bank and an Oil Company as an example, revealed the application of international arbitration, arbitration procedures and execution of awards. Partners Vincent Tan and Yaolong Zhu, participating as speakers, shared their experience and cases in international arbitration area. Partner Lanjun Xie raised questions about the current international investment situation and discussed the opportunities for investors after the signing of RCEP and the BIT between China and Singapore. Speakers also conducted in-depth discussions on various issues raised by the participants. Trainee attorney Jane Lin and attorney Danting Mao participated as a host and an interpreter.
Akash Mohapatra mentioned that ICSID, as a international arbitration institution, and BIT, as a treaty signed between countries, can provide timely relief and effectively protect the interests of international investors when their interests are effected or seeking relief in the host country is blocked. ICSID can solve the difficulty of investor rights protection and execution of awards to some extent.
The successful holding of the discussion further strengthen the interaction between the firm and foreign lawyers, provide new guidance for young lawyers in the context of increasing international investment, and effectively improve the level of the firm's diversified dispute resolution services.
