中銀資訊 | 我所代理珠海首例英文仲裁 A First-ever English Arbitration in ZCIA

由中銀港澳三地聯營所主任陳憶律師及我所高級合伙人譚岳奇律師帶領的專業(yè)律師團隊，代表國內某知名企業(yè)作為申請人于2022年8月28日參加于珠海國際仲裁院審理的英文仲裁案件。
On August 28th 2022, a professional team of lawyers led by Director Chen Yi of ZLF (Hengqin) Law Firm and Senior Partner Tan Yueqi of Beijing Zhongyin(Shenzhen)Law Firm acts on behalf of a well-known domestic enterprise as Claimant for an arbitration case conducted in English heard by Zhuhai Court of International Arbitration.
本案仲裁庭由三地仲裁員組成，首席仲裁員來自英國，兩名邊裁分別來自中國香港和新加坡，仲裁程序以遠程視頻方式進行。
The members of the tribunal of this case were constituted by a British presiding arbitrator, a HKSAR arbitrator and a Singaporean arbitrator. The arbitral proceedings is conducted in video-conference session.
本案的仲裁語言為英文，即包括仲裁申請、答辯、證據提交、程序性問題的申請和仲裁庭的決定、開庭、代理意見以及仲裁裁決等所有環(huán)節(jié)按照約定和仲裁規(guī)則均以英文進行。
Since both parties in this case had agreed to the fact that this arbitration proceedings shall be conducted in English, which means the following matters shall be conducted in English in accordance with the arbitration rule: the notice of arbitration, answers to the arbitration, presentation of the evidence, the application of the procedural issue, orders and hearing session of the arbitral tribunal, both parties’ submissions and the arbitral award, etc.
在陳憶律師和譚岳奇律師的精心安排下，經過團隊律師的充分準備，譚岳奇律師作為主要發(fā)言人，團隊陳恩智實習律師作為輔助發(fā)言人，庭審以英美法系的抗辯式程序進行，雙方當事人對爭議焦點展開了充分的辯論，庭審持續(xù)了6個小時，于當晚19:00圓滿結束。Having been orchestrated by Ms.Chen Yi and Mr. Tan Yueqi, upon full preparation of our team of lawyers, Mr. Tan Yueqi was the first counsel conducting advocacy while Mr. Chen Enzhi representing as the second counsel conducting advocacy. As the hearing was conducted in a widely-used adversarial procedure in common law system, counsels of the Claimant and Respondent debated intensively about the focus of the dispute. The hearing session lasted for 6 hours and ended successfully at 19：00.
此外，在本案中出庭的人員還包括中銀-力圖-方氏（橫琴）聯營律師事務所郭藝實習律師，北京中銀（深圳）律師事務所郭寧助理。
In addition, those who appeared in the hearing session included Trainee Lawyer Guo Yi of ZLF(Hengqin) Law Firm and Paralegal Guo Ning of Beijing Zhongyin(Shenzhen)Law Firm.
據悉，這是珠海國際仲裁院受理的第一起以英文作為仲裁語言的仲裁案件。
It is said that this is a first-ever arbitration case accepted by the Zhuhai Court of International Arbitration adopting English as the arbitration language.
